Artikel 1 : Algemene bepalingen
De e-commerce website van www.tokoberkatbelgium, een domeinnaam in handen van Geert Wauters gevestigd te Erpe Mere , Zandstraat 100 BTW BE0768425189 biedt zijn klanten de mogelijkheid om de producten uit zijn webwinkel online aan te kopen.
Onderhavige Algemene Voorwaarden ("Voorwaarden") zijn van toepassing op elke bestelling die geplaatst wordt door een bezoeker van deze e-commerce website (“Klant”). Het plaatsen van een bestelling via de webwinkel van toberkatbelgium.be houdt in dat de Klant deze Voorwaarden geraadpleegd heeft en de toepasselijkheid van deze Voorwaarden uitdrukkelijk aanvaardt, met uitsluiting van alle andere voorwaarden. Bijkomende voorwaarden van de Klant worden uitgesloten, behoudens wanneer deze voorafgaandelijk, schriftelijk en uitdrukkelijk door tokoberkatbelgium.be aanvaard zijn.
Artikel 2 : Prijs
Alle vermelde prijzen zijn uitgedrukt in EURO, inclusief BTW .
Indien levering-, reservatie-of administratieve kosten worden aangerekend, wordt dit apart vermeld. De opgave van prijs slaat uitsluitend op de artikelen zoals het woordelijk wordt omschreven.
De bijhorende foto’s zijn decoratief bedoeld en kunnen elementen bevatten die niet inbegrepen zijn in de prijs.
Artikel 3: Aanbod

Artikel 4: Online aankopen
De klant heeft de mogelijkheid om de artikelen uit het assortiment online aan te kopen. De aankoop komt tot stand op het moment dat de klant een bevestigingsmail ontvangt van Toko Berkat Belgium.
De klant kan tijdens de bestelperiode verschillende producten vanop de e-commerce website toevoegen aan zijn/haar winkelmandje.
Via de pagina 'afrekenen' dient de klant eerst zijn gegevens in te voeren alvorens een bestelling te kunnen vervolmaken.
De aankoop komt tot stand op het moment dat de klant de bevestigingsmail ontvangt van tokoberkatbelgium.be .
De Klant heeft de keuze tussen de volgende betaalwijzen:
- Via Bancontact, IDeal , Sepa Overschrijving
- Cash bij afhaling
Ongeacht de betaalwijze, heeft u steeds de mogelijkheid om een factuur aan te vragen. Voor verkopen aan professionele klanten, gelieve ons te contacteren in plaats van via de website te bestellen .
Tokoberkatbelgium.be is gerechtigd een bestelling (schriftelijk) te weigeren, ingevolge een ernstige tekortkoming van de Klant met betrekking tot de bestelling of elke andere bestelling of overeenkomst waarbij de Klant betrokken is.
Artikel 5: Levering en uitvoering van de overeenkomst
Artikelen besteld via deze webwinkel worden geleverd in België, Frankrijk, Luxemburg, Duitsland en Nederland. Voor leveringen in andere landen, gelieve ons te contacteren.
De levering gebeurt door BPOST ,Mondial Relay of DPD . De Klant maakt zelf de keuze tussen vervoerder en bezorgwijze in het bestelproces. De kost van de verschillende opties worden daarbij ook aangegeven.
De prijs van levering komt altijd bovenop de kost van de aangekochte producten.
Indien de Klant niet wenst te betalen voor levering is er de keuze om af gratis af te halen op het adres van tokoberkatbelgium.be te Erpe Mere.
Het tijdstip van afhaling zal na bestelling per e-mail of telefoon afgesproken worden.
We verzenden de producten – na ontvangst van uw betaling, zo snel mogelijk ( 1werkdag) . De levertijd van uw bestelling hangt af van welke bezorger jullie kiezen. Mondial Relay en DPD leveren binnen de 5 werkdagen terwijl BPOST een levertermijn voorziet van 3 werkdagen.
Als de bestelling binnen de 30 dagen niet werd geleverd, ontvang je een terugbetaling van de bestelling binnen de 10 dagen.
Elke zichtbare beschadiging en/of kwalitatieve tekortkoming van een artikel of andere tekortkoming bij de levering, moeten door de Klant onmiddellijk worden gemeld aan tokoberkatbelgium.be .
Het risico wegens verlies of beschadiging gaat over op de Klant vanaf hij (of een door hem aangewezen derde partij, die niet de vervoerder is) de goederen fysiek in bezit heeft gekregen.
Het risico gaat echter al over op de Klant bij levering aan de vervoerder, als de vervoerder van de Klant de opdracht heeft gekregen de goederen te vervoeren en deze keuze niet door tokoberkatbelgium.be was geboden.
Artikel 6: Eigendomsvoorbehoud
De geleverde artikelen blijven tot op het moment van gehele betaling door de Klant, de exclusieve eigendom van tokoberkatbelgium.be .
De Klant verbindt er zich toe zo nodig derden op het eigendomsvoorbehoud van tokoberkatbelgium.be te wijzen, bv. aan eenieder die op de nog niet geheel betaalde artikelen beslag zou komen leggen.
Artikel 7: Herroepingsrecht
Voor onze voedingsproducten geld het herroepingsplicht niet en dit om de reden dat deze producten een beperkte houdbaarheidsdatum hebben.
Voor onze niet-voedingsproducten en Pre order bestellingen heeft de koper het recht om van zijn aankoop af te zien binnen de 14 dagen , zonder boete en zonder opgave van motief.
Je mag het product in dat geval wel slechts behandelen en uitpakken in de mate die nodig is om het product te inspecteren.
De producten dienen onbeschadigd teruggestuurd te worden naar volgend adres: Geert Wauters , Zandstraat 100 , 9420 Erpe Mere . U dient ons binnen de 14 dagen na ontvangst van de bestelling schriftelijk via post of e-mail op de hoogte te brengen van deze beslissing en vervolgens de producten, binnen de 14 dagen, retourneren.
U ontvangt na aanmelding van retour binnen de 14 dagen een terugbetaling. De terugbetaling zal wel pas doorgevoerd worden als wij de producten in goede staat hebben ontvangen. Deze terugbetaling is, in het geval dat de volledige bestelling werd teruggestuurd, ook inclusief de leveringskosten. De terugbetaling zal gebeuren met hetzelfde betaalmiddel als waar oorspronkelijk mee werd betaald.
De kosten voor het terugzenden van de producten zijn ten laste van de Koper.
Artikel 8: Garantie
Indien een product niet overeenkomt met een besteld product of als het product niet in goede staat is, heeft u het recht op vervanging of terugbetaling. Neem hiervoor contact met ons op binnen de 24 u na ontvangst van de bestelling via mail: info@tokoberkatbelgium.be.
Artikel 9: Overmacht
In geval van overmacht zijn wij niet gehouden onze verplichtingen na te komen. In dat geval kunnen wij ofwel onze verplichtingen opschorten voor de duur van de overmacht, ofwel de overeenkomst definitief ontbinden.
Overmacht is elke omstandigheid buiten onze wil en controle die de nakoming van onze verplichtingen geheel of gedeeltelijk verhindert. Hieronder begrijpen wij onder meer, stakingen, brand, bedrijfsstoringen, energiestoringen, storingen in een (telecommunicatie-)netwerk of verbinding of gebruikte communicatiesystemen en/of het op enig moment niet beschikbaar zijn van onze website, niet of niet-tijdige levering van toeleveranciers of andere ingeschakelde derden, …

The Customer has the choice between the following payment methods:
Via Bancontact, IDeal, Sepa Transfer
Cash on collection
Regardless of the payment method, you always have the option of requesting an invoice. For sales to professional customers, please contact us instead of ordering via the website.
Tokoberkatbelgium.be has the right to refuse an order (in writing), following a serious deficiency on the part of the Customer with respect to the order or any other order or agreement involving the Customer.
Article 5: Delivery and execution of the agreement
Items ordered through this webshop are delivered in Belgium, France, Luxembourg, Germany and the Netherlands. For deliveries in other countries, please contact us.
Delivery is made by BPOST,Mondial Relay.or DPD . The Customer chooses the carrier and the delivery method in the ordering process. The cost of the different options will also be indicated.
The price of delivery is always in addition to the cost of the products purchased.
If the Customer does not wish to pay for delivery there is the choice to pick up the order free of charge at the address of tokoberkatbelgium.be in Erpe Mere.
The time of collection will be agreed after ordering by e-mail or phone.
We will ship the products - after receipt of your payment - as soon as possible (1 working day). The delivery time of your order depends on which delivery person you choose. Mondial Relay and DPD deliver within 5 working days while BPOST provides a delivery time of 3 working days.. We are not liable in case of delays by the delivery company.
If the order was not delivered within 30 days, you will receive a refund of the order within 10 days.
Any visible damage and/or qualitative deficiency of an article or other shortcoming in the delivery must be reported immediately by the Customer to tokoberkatbelgium.be .
The risk of loss or damage is transferred to the Customer as soon as he (or a third party appointed by him, who is not the carrier) has received physical possession of the goods.
However, the risk already passes to the Customer upon delivery to the carrier, if the carrier was commissioned by the Customer to transport the goods and this choice was not offered by tokoberkatbelgium.be.
Article 6: Retention of title
The delivered articles remain the exclusive property of tokoberkatbelgium.be until full payment by the Customer.
The Customer undertakes, if necessary, to inform third parties of tokoberkatbelgium.be's retention of title, e.g. to anyone who may come to seize articles that have not yet been paid for in full.
Article 7: Right of withdrawal
For our food products, the right of withdrawal does not apply and this for the reason that these products have a limited shelf life.
For our non-food products and Pre order orders , the buyer has the right to cancel his purchase within 14 days, without penalty and without giving any reason.
In this case you may only handle and unpack the product to the extent necessary to inspect it.
The products must be returned undamaged to the following address: Geert Wauters , Zandstraat 100 , 9420 Erpe Mere . You must notify us within 14 days after receipt of the order in writing by mail or email to notify us of this decision and then return the products within 14 days.
You will receive a refund after notification of return within 14 days. The refund will only be made if we have received the products in good condition. This refund is, in the case that the entire order was returned, also including the delivery costs. The refund will be made with the same means of payment that was originally used.
The cost of returning the products is borne by the Buyer.
Article 8: Guarantee
If a product does not match an ordered product or if the product is not in good condition, you have the right to replacement or refund. Please contact us within 24 hours after receipt of the order by mail: info@tokoberkatbelgium.be.
Article 9: Force majeure
In case of force majeure we are not obliged to fulfill our obligations. In that case we can either suspend our obligations for the duration of the force majeure or definitively dissolve the agreement.
Force majeure is any circumstance beyond our will and control that prevents the fulfillment of our obligations in whole or in part. We understand these circumstances to include strikes, fire, business interruptions, energy interruptions, disruptions in a (telecommunications) network or connection or communication systems used and/or the unavailability of our website at any time, non-delivery or late delivery by suppliers or other third parties, ...
Article 10: Customer Service
If you have questions about the products or something went wrong with the order or delivery, do not hesitate to contact us! Complaints must reach us within 24 hours after receiving the order. We will try to respond as soon as possible and find a good solution.

Article 11: Privacy
The controller, tokoberkatbelgium.be respects the Belgian law of 8 December 1992 on the protection of privacy in the processing of personal data. The personal data you provide will only be used for the execution of the contract entered into and the processing of the order (only tokoberkatbelgium.be and in case of shipment also the courier service have access to these data).
We will also include your details in our database for future promotional mailings. After receiving these mails, you always have the possibility to unsubscribe if you do not want to receive them anymore.
You have a legal right to access and correct your personal data. Subject to proof of identity (copy of your identity card), you can obtain a written, dated and signed request for a free copy of your personal data. If necessary, you can also ask to correct the data that are incorrect, incomplete or irrelevant.
The customer is responsible for keeping his log in data confidential and for the use of his password. Your password is stored in encrypted form and Tokoberkatbelgium.be cannot access it.
Article 12: Affection of validity -non-obviousness
If any provision of these Terms is declared invalid, unlawful or void, this will not affect in any way the validity, legality and applicability of the other provisions. The failure at any time by tokoberkatbelgium.be to enforce any of the rights listed in these Terms, or to exercise any of them, shall never be considered a waiver of such provision and shall not affect the validity of these rights.
Article 13: Modification of conditions
These conditions may, without prior notice, at any time be changed. At the time the order is placed, the General Terms and Conditions will apply as they were at the time the sale was made. Any order placed after the amendment or supplementation of the terms and conditions implies acceptance of these new supplemented conditions.
Article 14: Proof
The Customer accepts that electronic communications and backups can serve as evidence.
Article 15: Applicable law - Competent judge
Belgian law shall apply. The courts of the domicile of the tokoberkatbelgium.be are competent in case of legal disputes.
